1. Introduction
Bequest Marketing LLC (“Bequest,” “we,” “us,” or “our”) is a limited liability company organized under the laws of the State of Florida. We operate this website together with all associated landing pages, subdomains, forms, and scheduling tools (the “Site”).
We provide appointment generation services to mortgage brokers and lending professionals. In the course of that work we handle personal information belonging to two distinct groups: brokers who inquire about our services, and borrowers who respond to advertising we run on our clients’ behalf. This policy describes how we treat both. By using the Site you acknowledge that you have read and understood it.
2. Information We Collect
2.1 Information you give us
What we collect depends on who you are and how you reach us.
- Brokers inquiring about our services: name, business email address, telephone number, company name, the loan products you originate, the states in which you are licensed, and your scheduling preferences.
- Borrowers responding to our advertising: name, telephone number, email address, the type of financing sought, the approximate loan amount, the property type, the expected timeline, and any other details you provide during a telephone conversation with our staff.
2.2 Information collected automatically
When you visit the Site, we and our service providers collect technical information:
- Browser type, operating system, device type, and screen dimensions
- IP address and the approximate geographic region derived from it
- Pages viewed, links clicked, time on page, and referring and exit URLs
- Campaign parameters (source, medium, campaign) attached to inbound advertising links
2.3 Cookies and similar technologies
The Site uses cookies and similar technologies that fall into two groups.
Strictly necessary. Session cookies that keep the Site functioning and preserve the state of any form you are part-way through. These cannot be switched off.
Advertising, attribution, and analytics. These are optional, and we use the following:
- Meta Pixel — advertising measurement. Records page views and conversion events arising from our advertising on Facebook and Instagram, and builds audiences for future campaigns.
- Google Ads tag — advertising measurement. Records conversions from our Google advertising and builds remarketing audiences.
- Hyros — multi-touch attribution. Follows a visitor’s path across sessions and devices so that appointments and inquiries can be attributed back to the advertising that produced them.
- Vidalytics — video measurement. Where a video is embedded on the Site or on a campaign landing page, records play rate, watch time, and the point at which viewing stops.
- Umami — privacy-oriented web analytics. Counts page views and visitors in aggregate.
You can control optional cookies through your browser settings or a tracking-blocker extension; disabling them may limit some features. We do not currently respond to “Do Not Track” browser signals, as no uniform standard for honoring them exists.
3. Telephone and Text Message Communications
Telephone contact is central to our service. When you submit your telephone number through an advertisement or form connected to our campaigns, you consent to be contacted by Bequest at that number — including by automated dialing technology and by text message — regarding your inquiry. Consent to receive marketing calls or texts is not a condition of obtaining any financing, product, or service.
Message and data rates may apply. You may withdraw consent at any time by telling our representative during a call, by replying STOP to any text message, or by writing to us at the address in Section 13. Withdrawing consent for marketing messages does not prevent us from contacting you about an appointment you have already scheduled.
Calls with our representatives are recorded, and may be monitored, for quality assurance and training. Florida law requires the consent of all parties to a recorded conversation, so you will be told that the call is being recorded at the start of it. Recordings are retained and protected on the same basis as the other information described in this policy.
4. How We Use Your Information
- To respond to inquiries and schedule appointments
- To verify that a borrower meets the qualification criteria we apply before booking
- To arrange and confirm appointments on a broker’s calendar
- To contact you by telephone, email, or text message about your inquiry
- To measure advertising performance and improve our campaigns
- To maintain records, enforce our agreements, and comply with legal obligations
5. How We Share Your Information
If you are a borrower, the central purpose of our service is to introduce you to a lending professional. When we book an appointment for you, we provide that broker with your name, contact details, and the financing information you gave us, so that they can prepare for and attend the meeting. Once your information is in a broker’s hands, their own privacy practices govern how they use it, not ours.
We also share information with:
- Service providers who host our systems, deliver email and text messages, power our telephone systems, and provide scheduling and customer-record software
- Advertising and analytics platforms, in the form of measurement and conversion data
- Professional advisors such as our attorneys and accountants
- Legal and successor recipients, where disclosure is required by law or legal process, or in connection with a merger, acquisition, or sale of assets
We do not sell personal information for money.
California residents: sharing for cross-context behavioral advertising
We do not sell personal information for money. However, our use of attribution and advertising technologies — the Meta Pixel, the Google Ads tag, and Hyros — involves disclosing identifiers and activity data to third parties in a way that the California Consumer Privacy Act, as amended by the California Privacy Rights Act, treats as “sharing” for cross-context behavioral advertising. We disclose this plainly rather than rely on the absence of payment.
The categories of personal information involved are:
- Identifiers — name, email address, telephone number, IP address, and cookie or device identifiers
- Internet and network activity — pages viewed, links clicked, video engagement, and the campaign that referred you
- Inferences drawn from the above about your interest in financing
We share these categories with advertising, attribution, and analytics providers for the purpose of measuring campaign performance and building advertising audiences. We do not knowingly share the personal information of consumers under 16 years of age.
You have the right to opt out of this sharing. To do so, email info@bequestgrowth.com with the subject line “Do Not Sell or Share My Personal Information,” or block advertising cookies through your browser settings or a tracking-blocker extension. We will not discriminate against you for exercising this right. California residents also hold the access, correction, deletion, and portability rights described in Section 7, and may designate an authorized agent to act for them.
6. Data Retention
We keep personal information for as long as needed for the purposes described above, and afterward for as long as necessary to resolve disputes, enforce agreements, and satisfy legal, tax, and recordkeeping requirements. Records connected to telephone marketing consent are retained for at least five years, consistent with federal requirements.
7. Your Rights and Choices
Regardless of where you live, you may ask us to provide a copy of the personal information we hold about you, correct it, or delete it, and you may opt out of marketing communications at any time. Write to info@bequestgrowth.com. We will verify your identity before acting on a request.
Residents of states with comprehensive privacy laws
Several states — including California, Colorado, Connecticut, Virginia, Texas, and Florida — grant residents specific rights over their personal information, which may include access, correction, deletion, portability, and the right to opt out of targeted advertising or profiling. The rights available to you, and whether a given law applies to a business of our size, depend on your state of residence. We honor verified requests from residents of any state to the extent the applicable law requires, and we will not discriminate against you for exercising a right.
8. Data Security
We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
9. Breach Notification
If we determine that a breach of security has compromised your personal information, we will notify you and the appropriate authorities within the timeframes required by applicable law, including the Florida Information Protection Act.
10. Third-Party Links
The Site may link to websites we do not control, including those of brokers we work with. We are not responsible for the privacy practices of those sites, and we encourage you to read their policies.
11. Children’s Privacy
The Site is intended for adults engaged in commercial and residential lending activity. We do not knowingly collect personal information from anyone under 18. If you believe a child has provided us information, contact us and we will delete it.
12. Changes to This Policy
We may update this policy from time to time. The effective date at the top of this page shows when it was last revised, and material changes will be reflected there. Continued use of the Site after a revision constitutes acceptance of the updated policy.
